End-User License Agreement (EULA) & Terms of Use
IMPORTANT NOTICE: By downloading, installing, or using the GluClue mobile application, you agree to be bound by the terms and conditions of this End-User License Agreement (“EULA”) and Terms of Use. If you do not agree, do not install or use the application.
Clinical Disclaimer and Liability: The purpose of this application is to serve as an educational and logging tool to facilitate discussions with qualified healthcare professionals. The data, insights, patterns, or predictions provided by GluClue’s algorithms are not a substitute for professional medical advice, diagnosis, or treatment. GluClue is not responsible for any actions taken or not taken based on the information provided by the application. Always consult your physician, endocrinologist, or CDE before making any changes to your medication, insulin dosage, or treatment regimen.
1. The Opening / Acceptance
IMPORTANT NOTICE: By downloading, installing, or using the GluClue mobile application, you agree to be bound by the terms and conditions of this End-User License Agreement (“EULA”) and Terms of Use. If you do not agree, do not install or use the application.
2. Clinical Disclaimer and Liability
The purpose of this application is to serve as an educational and logging tool to facilitate discussions with qualified healthcare professionals. The data, insights, patterns, or predictions provided by GluClue’s algorithms are not a substitute for professional medical advice, diagnosis, or treatment. GluClue is not responsible for any actions taken or not taken based on the information provided by the application. Always consult your physician, endocrinologist, or Certified Diabetes Educator (CDE) before making any changes to your medication, insulin dosage, or treatment regimen.
3. License Grant
GluClue grants you a non-exclusive, non-transferable, revocable license to use the GluClue mobile application solely for your personal, non-commercial purposes on the device(s) that you own or control, and as permitted by the terms and conditions of this EULA. The Application is licensed, not sold, to you.
4. Intellectual Property
You acknowledge that GluClue and its licensors retain all title, ownership rights, and intellectual property rights in and to the Application, including all algorithms, code, user interface design, and content (excluding user-submitted data). You shall not modify, adapt, translate, reverse engineer, decompile, or disassemble the Application.
5. Restrictions
You agree not to use the Application for any purpose that is unlawful or prohibited by these Terms. You shall not attempt to gain unauthorized access to the Application or any data related to it. You shall not upload any content that infringes on the intellectual property rights or privacy rights of any third party.
6. Termination
This EULA is effective until terminated by either you or GluClue.
- Termination by You: You may terminate this EULA by permanently deleting the Application and all copies thereof from your devices.
- Termination by GluClue: Your rights under this EULA will terminate automatically without notice from GluClue if you fail to comply with any term(s) of this EULA. Upon such termination, you shall cease all use of the Application and destroy all copies of the Application.
7. Limitation of Liability
YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT THE USE OF THE GLUCLUE APPLICATION IS AT YOUR SOLE RISK. The Application is provided “AS IS” and without warranty of any kind.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL GLUCLUE BE LIABLE FOR ANY INCIDENTAL, SPECIAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION, OR ANY OTHER PECUNIARY LOSS, ARISING OUT OF OR RELATED TO YOUR USE OR INABILITY TO USE THE APPLICATION, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, OR OTHERWISE).
GluClue’s total liability to you for all damages shall be limited to the greater of: (a) the amount you actually paid for the Application, or (b) One U.S. Dollar ($1.00).
This limitation applies even if the remedies available to you fail of their essential purpose.
